Welcome to WeInk! These Terms of Service ("Terms") govern your use of our software-as-a-service (SaaS) platform ("Platform"). By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

Definitions

Platform: The WeInk software-as-a-service (SaaS) platform that allows users to log in, reserve tattoos, search for artists, and allows artists to manage reservations and chat with users. User: Any individual who accesses or uses the Platform. Artist: Any tattoo artist who uses the Platform to manage reservations and communicate with users. WeInk: The provider of the Platform.

Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement.

Account Registration

User Accounts

To use certain features of the Platform, Users must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for any activities or actions under your account.

Artist Accounts

Artists must create an account to manage reservations and communicate with users. Artists agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. Artists are responsible for safeguarding their passwords and for any activities or actions under their accounts.

Use of the Platform

User Conduct

Users agree to use the Platform only for lawful purposes and in accordance with these Terms. Users agree not to:

Use the Platform in any way that violates any applicable federal, state, local, or international law or regulation. Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Platform, or which, as determined by us, may harm WeInk or users of the Platform. Impersonate or attempt to impersonate WeInk, a WeInk employee, another user, or any other person or entity.

Artists agree to use the Platform only for lawful purposes and in accordance with these Terms. Artists agree not to:

Reservations and Payments

Reservations

Users can reserve tattoos through the Platform. Artists are responsible for managing their own reservations and availability. WeInk is not responsible for any issues arising from reservations, including cancellations or no-shows.

Payments

Payment terms for tattoos and services will be agreed upon between the user and the artist. WeInk may facilitate payments through third-party payment processors, but is not responsible for any issues related to payments.

Communication

User Communication

Users can communicate with artists through the Platform. All communications must comply with our Acceptable Use Policy.

Intellectual Property

The Platform and its entire contents, features, and functionality are owned by WeInk, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Platform.

Limitation of Liability

In no event shall WeInk, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Platform; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Platform; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Platform by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Platform; and/or (vi) the defamatory, offensive, or illegal conduct of any user or third party. In no event shall WeInk be liable for any claims, proceedings, liabilities, obligations, damages, losses, or costs in an amount exceeding the amount you paid to WeInk hereunder or $100.00, whichever is greater.

Governing Law

These Terms shall be governed and construed in accordance with the laws of [Insert Jurisdiction], without regard to its conflict of law provisions.

Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Platform.
